In view of the challenge of legislating artificial intelligence in Argentina and the warnings about the possible effects of the advance of artificial intelligence, a bill was recently introduced with the aim of moving towards a regulatory framework for the ethical operation of Artificial Intelligence.
The purpose of this bill is to update Science, Technology and Innovation Law No. 25,467 by incorporating Artificial Intelligence Systems (AI). This is based on the understanding that it is essential to provide clarity and legal certainty for the current and future development of artificial intelligence in our country, with ethical principles and values being the foundation on which any regulation in this field must be built.

The text proposes the amendment of 3 articles to be incorporated into Law 25,467. Its main objective is to promote the development, creation, application and, ultimately, the entire life cycle of artificial intelligence, based on the ethical principles and values of Law No. 25,467.
The first article provides that “the National Science, Technology and Innovation System, in order to regulate the ethical operation of Artificial Intelligence systems,” shall be governed by the values of “diversity, inclusion, peace and justice.” The aim is to ensure that the advance of artificial intelligence guarantees the participation of all persons or groups, regardless of their race, color, ancestry, gender, age, language, religion, political opinions, ethnic or social origin, economic status or any other form or condition that could undermine respect for diversity and social inclusion.
In addition, it seeks to ensure that the progress of artificial intelligence guarantees peace and justice among nations, without undermining human freedom or reducing people’s autonomy of decision; and without jeopardizing individual or collective security, dividing or pitting people and groups against each other, or threatening coexistence between human beings, other living beings and the environment.
The second article to be included establishes the obligation to register artificial intelligence systems, which will be monitored by an existing body, the Scientific and Technological Cabinet (GACTEC). This entity will order the suspension of research, development or application activities when it considers that ethical principles and values are being violated.
Finally, the third article opens the possibility for any individual or legal entity that considers itself threatened or harmed by an artificial intelligence system to file a complaint requesting a review of the system.
This initiative highlights that scientific and technological research have the potential to generate great benefits for society as a whole, and that advances in Artificial Intelligence must therefore guarantee the quality and safety of research through the establishment of clear rules and regulations.
